5. Privacy Policy Notice

5.1 Who Controls the Information

BOTE LLC is the controller or business responsible for personal information collected directly through LearnEnglishAbc.com, except where a school, employer, reseller, or other organization acts as the controller and BOTE LLC acts as its service provider or processor.

5.2 Information We May Collect

Account identifiers, including name, username, email address, password credentials in protected form, country, language, and account preferences.

Subscription and transaction information, including plan, purchase date, amount, currency, payment status, invoices, refunds, and payment-processor identifiers. BOTE LLC generally does not receive complete payment-card numbers.

Technical information, including IP address, approximate location derived from IP, browser, device type, operating system, language, identifiers, logs, and security events.

Usage information, including pages viewed, lessons used, books downloaded, features selected, session duration, clicks, errors, and learning progress.

HOPE interaction information, including text prompts, responses, conversation transcripts, language selections, pronunciation or speech-analysis results, usage balances, and saved lessons.

Voice and audio information when a user activates speaking features. Audio may be transmitted to speech-processing and AI providers to produce a response.

User Content, including writing samples, comments, reviews, profile information, saved materials, uploaded content, and support messages.

Cookie, analytics, advertising, and referral information described in the Cookie Policy.

Information received from payment providers, identity or fraud-prevention providers, schools, organizations, resellers, referral partners, or social-login providers when the user chooses those services.

5.3 How We Use Information

Create and administer accounts.

Provide lessons, books, downloads, HOPE conversations, speech processing, saved lessons, support, and purchased services.

Measure HOPE usage and maintain balances.

Process payments, renewals, cancellations, refunds, taxes, and transaction records.

Personalize language, difficulty, lesson recommendations, and accessibility settings.

Operate, troubleshoot, secure, test, and improve the Services.

Detect fraud, abuse, prompt injection, unauthorized access, scraping, malware, and violations of these Terms.

Send transactional notices and, with the consent required by law, marketing communications.

Comply with legal duties, respond to lawful requests, establish or defend claims, and enforce agreements.

Conduct analytics and advertising as described in the Cookie Policy and applicable consent controls.

5.4 Legal Bases for Processing

Where a legal basis is required, BOTE LLC relies on one or more of the following: performance of a contract; steps requested before entering a contract; consent; compliance with legal obligations; protection of vital interests when applicable; and legitimate interests such as security, fraud prevention, support, service improvement, and business administration, balanced against the user's rights.

5.5 AI and Voice Data

HOPE is operated with third-party AI, speech, translation, avatar, hosting, database, and security providers. User text, audio, transcripts, and related technical data may be sent to those providers only as reasonably necessary to operate, secure, or support the requested feature.

BOTE LLC does not use private HOPE conversations for third-party advertising. BOTE LLC configures commercial AI services, where such controls are available, so that private customer content is not used to train a provider’s general-purpose AI models. If BOTE LLC materially changes how private conversations are used, it will provide appropriate notice and obtain consent where required by applicable law.

Users must not submit passwords, complete payment-card information, government identification numbers, medical records, highly sensitive personal information, confidential business information, or another person’s private information through HOPE unless the information is expressly requested through a specifically authorized and secure feature.

5.6 Sharing and Disclosure

BOTE LLC may disclose information to the following categories of recipients:

Hosting, database, content-delivery, cybersecurity, customer-support, email, analytics, accessibility, and technical service providers.

AI model, speech-recognition, text-to-speech, translation, avatar, and related technology providers.

Payment processors, app stores, tax providers, fraud-prevention providers, banks, and transaction-service providers.

Advertising, analytics, affiliate, and referral providers, subject to consent and opt-out rights where required.

A school, employer, organization, parent, or account administrator that purchased or controls the applicable account, subject to the agreement and applicable law.

Professional advisers, auditors, insurers, financing sources, and prospective or completed business transaction participants under appropriate confidentiality restrictions.

Courts, regulators, law-enforcement authorities, or other persons when required by law or reasonably necessary to protect rights, safety, systems, users, or the public.

5.7 Sale or Sharing for Advertising

BOTE LLC does not sell personal information for money. Some advertising, analytics, or cookie activity may be classified as a "sale," "sharing," or targeted advertising under certain privacy laws even when no money is paid for the data. Where applicable, BOTE LLC will provide a Do Not Sell or Share or equivalent opt-out method and honor recognized browser-based opt-out signals as required by law.

5.8 Retention

BOTE LLC retains each category of personal information only for the period reasonably necessary for the disclosed purpose, account administration, security, legal compliance, tax and accounting obligations, dispute resolution, backups, and enforcement. Criteria include whether the account is active, whether the user saved the information, the sensitivity of the data, contractual obligations, legal limitation periods, security needs, and the ability to delete information from active systems and backups.

Saved HOPE lessons or transcripts may remain available for the period stated in the applicable plan or user dashboard and may be deleted earlier by the user where the feature permits. BOTE LLC may retain limited transaction, security, consent, and dispute records after account deletion.

5.9 International Transfers

BOTE LLC is based in the United States, and providers may process information in the United States and other countries. Where required, BOTE LLC uses recognized transfer mechanisms or contractual safeguards and provides information needed to exercise applicable transfer-related rights.

5.10 Security

BOTE LLC uses administrative, technical, and organizational safeguards designed for the nature of the Services and information processed. No online service can guarantee absolute security. Users must protect their credentials and promptly report suspected unauthorized access.

5.11 Privacy Rights

Depending on location and applicable law, a user may have rights to request access, correction, deletion, restriction, objection, portability, withdrawal of consent, an appeal, or information about collection and disclosure. Users may also have a right to opt out of targeted advertising, sale or sharing, or certain automated processing.

Submit a privacy request to support@learnEnglishAbc.com with the subject "Privacy Request." BOTE LLC may verify identity and authority before completing a request. Authorized agents may be required to provide proof of authority. BOTE LLC will not unlawfully discriminate against a user for exercising a privacy right.

5.12 Complaints

Users may contact BOTE LLC first so the concern can be investigated. Where applicable, users may also complain to a privacy, consumer-protection, or data-protection authority in their country or state.

5.13 Data Breach and Security Notices

If BOTE LLC determines that a security incident requires notice under applicable law, BOTE LLC will provide legally required notifications to affected users, regulators, or other parties within the required time and by the permitted method.

6. Cookie, Analytics, and Advertising Technologies

6.1 Types of Technologies

LearnEnglishAbc.com may use cookies, local storage, pixels, tags, software development kits, device identifiers, server logs, and similar technologies.

Strictly necessary technologies support login, security, payment, preferences, fraud prevention, and core website functions.

Functional technologies remember language, accessibility, display, and account preferences.

Analytics technologies measure traffic, performance, errors, and feature use.

Advertising and affiliate technologies may measure campaigns, limit repeated ads, attribute referrals, or personalize advertising where permitted.

6.2 Consent and Controls

Where law requires consent, non-essential technologies will not be activated until the user makes a choice through the cookie banner or preference center. A user may later change that choice. Withdrawing consent does not affect processing that was lawful before withdrawal.

Browser settings can block or delete cookies, but some Services may not function correctly. Where legally required, BOTE LLC will recognize applicable Global Privacy Control or similar universal opt-out signals.

6.3 Third-Party Cookies

Third-party analytics, advertising, video, payment, social-media, and embedded-content providers may place or access cookies and similar technologies in accordance with their own privacy notices. Where required by applicable law, BOTE LLC will make available information identifying material cookie or technology providers, their purposes, and relevant retention or duration information.

9. Age Requirements and Children's Privacy

9.1 Minimum Age

A person must be at least 13 years old to create an individual account unless BOTE LLC has implemented an approved parent-, guardian-, school-, or organization-managed process for younger learners. Public learning materials that do not require personal information may be viewed by younger learners with adult supervision.

9.2 Parental Permission

Users under the age of legal majority must have permission from a parent or legal guardian. Where local law requires parental authorization for online consent at an age between 13 and 16 or another age, the required parent or guardian authorization must be obtained.

9.3 Children Under 13

BOTE LLC does not knowingly allow a child under 13 to create an independent account or submit personal information, voice recordings, or HOPE conversations unless BOTE LLC has provided required notice and obtained verifiable parental consent or another lawful exception applies.

9.4 Voice and Transcript Information

A child’s voice may constitute personal information. Parent-, guardian-, school-, or organization-managed services must provide all legally required notices and obtain all required consents before collecting voice recordings or transcript information. BOTE LLC minimizes the collection and retention of this information and provides deletion controls appropriate to the service.

9.5 Discovery of a Child's Information

If BOTE LLC learns that it collected a child's personal information without required authorization, it may suspend the account and delete the information after taking steps required by law. A parent or guardian may contact support@learnEnglishAbc.com with the subject "Child Privacy Request."

9.6 Child-Safe Design

For services likely to be accessed by children, BOTE LLC aims to use age-appropriate language, privacy-protective defaults, data minimization, suitable content controls, and reasonable safeguards consistent with applicable children's privacy and safety requirements.

13. Email and Electronic Communications

13.1 Transactional Communications

By creating an account or purchasing a Service, a user agrees to receive necessary transactional and service communications, including account verification, password reset, security alerts, receipts, renewal and cancellation information, support responses, material policy notices, and service-operation messages.

13.2 Marketing Communications

Marketing email is optional where consent is required. A user may unsubscribe by using the link in a marketing message, changing account preferences where available, or emailing support@learnEnglishAbc.com with the subject "Unsubscribe." BOTE LLC may continue to send non-promotional transactional messages.

13.3 Delivery

The user is responsible for maintaining an accurate email address and checking spam or filtering settings. Electronic notice is considered provided when sent to the email address on the account or displayed through the website or account dashboard, subject to applicable law.
